State Laws Protecting Disability Benefits
The government ensures their peoples security by providing them with short-term and
long-term benefits under State Disability Laws that would help them in their everyday necessities. These benefits from the government aim to help those who are poor, retired, unemployed, and disabled.
There is Supplemental Security Income which would help those who are laid-off and are looking for a new job. It also supports the poor in their everyday needs and the disabled who would not be able to earn compensation income.
Funds for these benefits are taken from general taxes and so anyone under these categories can apply for benefits. Workers who have been disabled can receive benefits only up to a number of weeks before he is able to work again.
Disability Programs
In each state, there are different programs that would cater to the needs of their people. In California, there is a state disability insurance which is paid for by workers through payroll taxes and by a self-employed who has enrolled in elective coverage.
The disabled are paid every other week with 55% of the persons income rate before he has incurred the disability. It would be given to the victim and his family to be able to buy medications needed by the patient.
A paid family leave is also included under the provisions of state disability insurance. A family member of the disabled is allowed to take a leave to care for the patient or a newly born child.
Social Security Disability Insurance Program
This disability insurance program benefits workers who have paid rightful amount of taxes and certain family members who have been disabled. Children of employees qualified for this program can also avail of the benefits if they have incurred the disability before they reach the age of 22.
Workers could only qualify for this program if they have earned certain number of points acquired by paying social security taxes and by working for a number of years prior to being disabled.
Applying for Disability Programs
An agency in charge in giving out benefits should be meticulous to make sure that all beneficiaries are qualified so that taxes would be allotted properly and that everyone who has been approved of the benefits will receive the lawful amount of compensation.
According to the Social Security Agency, they turn down more than have of applicants who would want to receive benefits.
The application process for these claimants would take a couple of weeks or even months without an assurance that they are eligible. To make sure that a disabled is qualified, he must be under these following conditions:
The applicant must be prevented to work by a mental or physical condition and is not getting compensation salary.
The applicant must be under the age of 65.
The said disability of the applicant must last for more than two years or be recognized as a permanent disability.
The applicant must have worked for at least five years of the ten-year period prior to acquiring the disability.
Those that have been denied of their claims should not lose hope as they can still file an appeal and gather evidence that would prove they are indeed rightful recipients of the benefit.
Most of rejected applicants give up easily and refuse to file an appeal which would prove that they should be given benefits. We must keep in mind that we are protected by State Disability Laws and so we should fight for our legal benefits if we are qualified for them.
