The FINRA organization is in charge of making sure that people who sell security products are being as honest as they can. They have established rules and procedures that representatives are suppose to follow. An agent straying away from the rules could be held liable for damages if a client complains. The license of the agent to practice could be canceled if they have done something wrong.

The rules are there to make sure that a customer is taken care of very well. They should not be talked into purchasing riskier stocks if they are inclined to accept a high risk. A person must also be able to afford suffering any possible losses. A representative should not talk someone into investing money into things that they would not normally want to purchase.

When the investor suffers a loss that will often seek ways to recover their money. One of the methods that some people employ is to make a charge that the representative gave them faulty information or behaved against the interests of the investor. There are steps one needs to follow to make these claims.


The arbitration process is done in a methodical manner. The first thing a client will want to do is file a claim. This will be when they state what the problem is and what they want done about. Copies of the paperwork will go to FINRA, the broker, and the brokerage firms that are directly involved.


All the forms will go to the representative and the brokerage firms for them to look over. When they have ascertained what has happened and feel they have defense against the charges, they will talk with the person filing the claim. There is a possibility everything might get resolved at this point. If they continue to disagree, then a court date will be set.

Both sides will share information to study what happened. This process of discovery is to unearth any pertinent material which could help to clarify matters. The parties will go to a hearing where an arbitrator will decide how the issue will end. The arbitrator may even decide to award the complainant money if their case has merit.
