Still no Justice in Midland, Ontario for Victim of Graham Cutforth


Sentencing for Graham Cutforth who was arrested for Sexual Interferrence of a Minor after having sexually assaulted a blind little girl for 9 months has once again been postponed. In May 2010 Graham Cutforth was arrested for this assault. On October 4 he was allowed to plead guilty to a lesser charge of assault by a FEMALE Crown Attorney, Bhavna Bhangu, from Barrie. The reason given to the victim's family was the the crown felt the victim, was too scared to testify. This Crown Attorney never offered the victim the opportunity to testify via video of behind a screen. It seems the Crown only wanted to have a quick conviction to save the courts time and money rather than to see that Justice prevailed and the community was protected.

The sentencing for Graham Cutforth was to have been on November 4. The victim's family came to court and the victim's mother came ready to read the victim's impact statement. Most importantly after months of councilling the victim herself was able to come to court and face her attacker. She had gathered up the courage to try and put closure on this horrifying event.

After sitting waiting to be called to court it was noticed that Graham Cutforth had not showed up. Apparently his lawyer had approahed the Crown and asked for a continuance. This was granted but no one told the victim or her family. After waiting an hour and a half the victim's mother tried to get answers. The crown was too busy to talk to her and she finally found and spoke to Mr. Cutforth's lawyer who told her sentencing was now going to be on December 2.


While waiting for court a detective asked to speak to the victim's mother. Apparently some Midland citizen had been handing out flyers in Midland warning residents of Mr. Cutforth's behavior and telling anyone if their children had contact with Mr. Cutforth tonotify the police. It seem Midland residents care more about protecting their children than the courts do.

Last Thursday, December 2, 2010, the victim and her family again went to court for the sentencing and to read their victim impact statement. Once again after gathering the courage to go to court and face her attacker this little girl was sent home with no closure. Sentencing has once again been postponed. This time to December 13.

What is the court system teaching our children? We are teaching them that victim's have NO rights, especially if they are women or children. We are teaching them that not only will they be victimized by the perpetrators, but by the Crown Attorneys and courts that are supposed to protect them.
