The Types Of Employees
Private companies and employees of the private sector are assumed to be riding on a wave of free employment schemes
. Formally called an "employment at will" doctrine, this is defined as both employer and employee having the privilege to end their working relationships without any explanation or prior reason for as long as it does not become illegal (like breach of contracts for example). An employer in this case has the right to terminate the employee with legal reasons (when declaring bankruptcy), and the employee has the choice to leave the company prematurely too (family issues, moving, etc).
However, cases do exists where the employer can be charged for criminal activity by the law if he is found out to have terminated an employee due to discrimination. Several state and federal laws require the employer to fire an employee within reason. Terminating an employee's contract because of their sexual orientation, race, national origin, disability and such is considered discrimination.
Discrimination in itself is not a criminal act, almost anyone has some sort of discrimination peeve. But it starts violating the law when people take it upon themselves to act on it. These days, several government bodies have taken it to themselves to ensure that discrimination is considered a serious work problem in order to give the proper attention to create laws surrounding it.
Employees in the same way, have the right to end their contract and terminate his relationship with the employer. They have rights to do so on several factors. In example, if they find that the job they have been given does not fit their qualifications or their job description, or if there is discrimination going on that makes it uncomfortable for them and less effective at work. Employees that leave the company due to self-termination sometimes may not be subjected to after-employment benefits, but it may not be the case with other companies, or if the company was the one who terminated them.
Public sector employees and private sector employees are governed by the same laws and the same acts under different conditions. It is important that the employee should be informed about the particulars that bind them to their employers. This could insure a good working relationship with their employer and help them through tough times.
