Understanding Transvaginal Mesh Lawsuits

Medical technologies are continually evolving and new treatments arise every day

. Unfortunately, sometimes the treatments that are used on patients turn out to be more dangerous than they originally appeared. There are a startling number of cases where a medical product or device turns out to cause unintended harm or negative consequences, with devastating effects. One recent example of this is transvaginal mesh.

Transvaginal mesh or surgical slings were implanted in millions of women to provide support for pelvic organs. Transvaginal mesh was used as a treatment for a condition called pelvic organ prolapse in which the organs of the pelvis began to protrude into the vaginal wall. Transvaginal mesh was also used as a treatment for stress urinary incontinence, a condition in which urine is involuntarily released during physical activity such as exercise or even laughing or sneezing due to weakening of the pelvic muscles supporting the urethra and bladder.

Unfortunately, countless women who had transvaginal mesh implanted began to experience significant complications. Many of these women are now filing transvaginal mesh lawsuits.

What are a Transvaginal Mesh Lawsuits?


Transvaginal mesh lawsuits are lawsuits brought by women who used the defective transvaginal mesh devices to try to solve their health problems. Women who used these surgical slings have begun to experience complications including erosion of the mesh into the tissue of the vagina; exposure of the mesh; puncture of the bladder; recurrent pelvic organ prolapse, and perforation or puncture of the bladder, bowels and intestines. Some women are also experiencing vaginal bleeding, infections, drainage or discharge and many are experience pain during sex.

The women who are experiencing these side effects were not expecting them to occur and were not warned that they would occur before they agreed to have their doctors implant the surgical slings. As such, these women are seeking compensation for the problems that developed and for the resulting financial loss and discomfort they are enduring.

Who is Being Sued?


The manufacturers of the defective transvaginal mesh products are being sued because they breached the duty they owe to the public. They breached this duty by producing a product that turned out to be dangerous and cause significant unexpected side effect. Some of the manufacturers who are involved in transvaginal mesh lawsuits include American medical Systems, Boston Scientific, C.R. Bard, Inc. and Johnson & Johnson.

What Damages are Available?

A variety of different damages may be obtained by the women filing transvaginal mesh lawsuits. Damages include compensation for medical costs, including for the multiple surgeries that may be necessary to correct many of the complications associated with the defective vaginal mesh. Compensation for lost wages due to injuries resulting from the mesh, as well as for pain and suffering and emotional distress, may also be obtained as well. In certain instances, the spouses of the women affected may be able to bring an action for loss of consortium (loss of marital relations). Punitive damages may even be available to victims bringing transvaginal mesh lawsuits in appropriate cases.
