University Drug Charges Make Headlines

In a case that extended beyond Fort Worth, making headlines in Houston

, Austin, and the rest of the nation, the recent arrest of 18 people in a drug sweep at Texas Christian University (TCU) has also brought comments from a criminal defense lawyer.

According to Toby Shook, a former assistant DA for Dallas County who now practices as a criminal defense lawyer, those arrested will most likely not face serious time behind bars because most of them do not have prior criminal records. In addition, Shook notes that although the case has drawn national attention, the actual drug sales were not significant compared to what prosecutors normally see.

For those unfamiliar with the case, 18 people associated with Texas Christian University, including football players and other students, face various criminal charges related to drugs, including selling drugs in close proximity to a school. Shook does not believe that there will be any more arrests because he thinks this operation was meant to send a message to the student body rather than an attempt to make a huge drug bust on a large supplier.

A look at the actual arrest warrants reveals that even the most serious only involve alleged sales of marijuana for totals less than $1,600, 250 Xanax that were supposedly sold for $750, and criminal charges against an alleged buyer who is accused of participating in three buys totaling $1,800. Shook notes that in his experience as a criminal defense lawyer, "These are small, hand-to-hand deliveries of drugs."


Regardless of the size and amounts of the sales and buys, those arrested are still facing criminal charges and could face prison time. Even if they do not go to prison, if convicted, they will face probation with multiple requirements.
