Uscis Issues Guidance On Transitional Worker Program For Northern Mariana Islands

The Commonwealth of Northern Mariana Islands (CNMI) has been a part of the American political family since 1975

. United States Citizenship and Immigration Services (USCIS) published an interim final rule in the Federal Register in early November creating a new category of visa classification called the Transitional Worker in the CNMI.

The Transitional Worker Program is part of several steps taken under the Consolidated Natural Resources Act of 2008 (CNRA) to expand the US immigration law in the region. This law will come into effect on November 28, 2009. To facilitate a smooth transition from the CNMIs permit system to U.S. immigration law a period of transition will commence from this date.

A transitional worker is an alien worker who is ineligible for classification under any other category of the Immigration and Nationality Act and who performs labor or services for an employer conducting legal business in the Commonwealth of Northern Mariana Islands. However, to obtain the transitional worker visa, the applicant should be petitioned for by his employer using Form I-129CW with a fee of $320. This fee may be waived under certain circumstances but the employer should prove that he is capable of paying the employee his wage. The transitional worker visa can be obtained for the principal worker as well his dependents.

Once in effect, the Transitional Worker Program will enable the non-immigrant worker to travel back and forth from CNMI with the transitional worker visa and other mandatory readmission visa. The transitional period ends on December 31, 2014 and the transitional worker visa will not be valid once this is over. After that, the worker must apply for another status under the Immigration and Nationality Act.


The main aim of introducing the Transitional Worker Program is to bring about a systematic switch of the workers status from the permit system to the US immigration law.
