A second offense can be classified both as Class B misdemeanor or Class A misdemeanor if there is a passenger under the age of 16 in the vehicle, or the passenger in the vehicle is under the age of 18 and the driver is over the age of 21 or bodily injury is caused. It will be considered a third degree felony If serious bodily injury was caused or you have had a prior DUI conviction, then such infraction is considered as a third degree felony. The third infraction is imposed with a penalty of: 1) 1500 hours in jail or house arrest, 2) $1,500 fine, 3) supervised probation, 4) alcohol screening and education and 5) ignition interlock device installation.

It is considered as a third degree felony if there are three or more infractions in 10 years time. Since, the penalties for DUI violations are so severe, a DUI attorney is needed.
