Utah Plaintiff Sues Stryker Orthopedics Over Hip Implant Side Effects
A plaintiff from Utah has filed a lawsuit against Stryker Orthopedics over its Hip
implant device that allegedly caused many side effects and health complications to her. According to reports from various sources the Stryker hip implant lawsuit was filed on November 9, 2012, by Erma Neagle in the U.S. District Court for the District of Utah.
According to the lawsuit the plaintiff was diagnosed with degenerative joint disease in her right hip in 2010 and subsequently underwent a hip replacement surgery. According to the documents the hip replacement surgery was performed on November 16, 2010 and she was implanted with the Stryker Rejuvenate device. According to the lawsuit filed by the plaintiff and her hip implant attorney, Neagle experienced chronic inflammation and severe pain at the site of the implant that compromised the quality of her life. The plaintiff has also claimed that she experienced many side effects and complications that demanded a recovery time that was abnormally long. Some other side effects that the plaintiff experienced include infection and radiating pain at the site of the implant.
The plaintiff argued that the manufacturer of the device should have informed health care professionals and patients adequately about the potential harmful effects of the device. With the lawsuit the plaintiff brings in a number of counts against the defendant including negligence, product liability, concealment of relevant clinical trial data, breach of warranties and misrepresentation. The plaintiff argued that there should be some deterrent against such negligence and that she is entitled to receive adequate compensation for the physical pain and mental distress that she suffered due to the hip implant device.
