Plaintiff in error, Jesse Maughs, was tried upon a warrant issued by a justice of the peace of the city of Charlottesville. The warrant alleged that Maughs "in the said city did unlawfully operate an automobile in a careless and reckless manner, in violation of an ordinance of said city.Jesse Maughs challenged the judgment of conviction and sentence for the crime of reckless driving in violation of a Charlottesville, Virginia ordinance that was entered by the Corporation Court of the City of Charlottesville (Virginia). The corporation court fixed Jesse Maughs's punishment at a fine of $ 100. Prior to his appeal to the corporation court, a justice of the peace had set the fine at $ 10.

Discussion:

The Court note that "The facts upon which the charge of reckless driving is based are fully set forth the evidence of the witness T. H. Adams, relative to the charge of reckless driving. Although defendant's speed was not excessive, he did not turn on his lights at a time that he was required by law to do so.

The Court held that "Because of the defendant's failure to have lights on his car while driving over the city streets at a time of night when lights were required, was one of fact. While the evidence is meager, we cannot say the evidence is not sufficient to sustain the verdict." The judgment of the court will be affirmed.
