Weather: A Strong Chance Of Accident Claim

In recent years the severity of the weather in the UK during the winters has led many a grandparent to reminiscing about the good old days. In January 2010 the temperatures plummeted and we saw large amounts of snow, which helped contribute to the coldest winter for over a century. The following winter wasn't much better and we saw sustained periods of snow and nice, making conditions treacherous. The harshness of our recent winters has meant an increase in the number of people seeking to bring an accident claim.

Increase in driving accidents

The presence of ice and snow on the roads of course greatly increases the likelihood of accidents. Most insurance firms will see an increase of almost 25% during periods of such weather and accidents involving just a single vehicle can rise by around 80%. Those that are involved in an accident where another party was going too fast for the conditions are of course entitled to bring an accident claim.

However, if you are the only vehicle involved in an accident, then it is likely that you will be seen as responsible for the crash regardless of the conditions. This is because; although the Highways Authority has a duty to ensure that road users are not endangered by snow and ice, if they can show that they have taken reasonable steps to discharge their duty they cannot be held accountable.

Slips and falls

The other common area that sees an increase in accidents during cold snaps is that of trips and falls. These usually take place on pavements and walkways, accounting for a large number of accident claim cases. It is the responsibility of local councils to ensure the pathways are properly gritted and if they fail to complete the job properly and you have fall as a result of it, then you have a strong chance of winning an accident claim. To avoid this kind of accident claim being brought against them, some local councils have even resorted to not gritting paths. This is because failure to grit the path properly leaves them liable, whereas not gritting them at all does not.
