False accusations happen every day in custody situations
. What if you are one of them? What do you do if you are falsely accused of either sexual molestation of your children or domestic violence? You may think the truth will win out in court, but the sad fact is often the truth means nothing in these situations. But the first step towards handling the situation is realizing it can happen. Next is knowing there are some things you can do. Here are some of them:
Be Willing to Fight Back
While anger, rantings and ravings will serve no purpose, it doesn't mean you have to take it sitting down. Be prepared to fight back and do it consistently and with determination to clear your name. Nothing else will do. A defeated attitude won't help anything either.
Prepare a Civil Suit
Defamation of character is cause for a civil suit. The minute she slaps you with a false allegations, file your own claim for this and for the emotional distress and damage she can cause to your job and personal relationships.
Never Quit
You want to see your kids and that is understandable. This is where many fathers cave and give in. They accept terms that are unacceptable to have their name cleared and they simply give up. Don't do it. It won't be worth it in the long run.
Restraining Orders are Likely
You also need to know that if you are falsely accused everyone is going to encourage her to get a restraining order. Don't get upset or try to see the kids or her anyway even if she tries to get you to break it. Obey the law.
Know You Rights
This is the single most important thing you can do as a father. Know your rights, know what you can and can't do. Don't believe rumors such as you can't sue your Ex. You have to fight your battle well-armed and knowing your rights allows you to do this.
