Court forms are provided for your convenience. Some forms you may fill out on-line, however, the applicant still needs to print out the form, sign it and then submit it to Barnstable County Probate and Family Court. If you are an executor of someone's will you may need a legal document called a 'grant of probate' to enable you to sort out the deceased person's affairs. If there is no will, a close relative can apply for a 'grant of letters of administration'. Forms not available in Word The selection of which word processing solution to use to fill out the form can cause inconsistencies. Even the selection of which printer to use to print the form can lead to results that are inconsistent and impractical to process. Users of completed forms (court staff, judges, parties, etc.) expect to see specific content in consistent locations on the form. When that content shifts as a result of printer and word processor anomalies, then the value of standardized forms is diminished.All of these forms can be printed as blank forms and filled in manually if required. All these forms can be saved to local electronic media in their blank state. Users are cautioned that when they pre-print a form for later use or save a copy of a form to local media, they need to make sure that the form has not changed since it was last printed or saved locally. It is the users responsibility to check the court's website for updated forms to avoid using obsolete and outdated forms. The Probate Court is responsible for appointing guardians and conservators for incapacitated adults and minors who cannot make responsible decisions about themselves or their property. In these cases the judge must decide whether the person in question has a mental, physical or legal limitation which requires the judge to appoint a guardian to make decisions concerning the persons health and personal life or appoint a conservator to make responsible decisions concerning management of property and money. A Conservator is responsible for filing detailed/accurate annual accounts with the Court. The Probate Court is also responsible for reviewing guardianships at the end of one year and every three years thereafter for adults. For minors the court is responsible for reviewing the guardianship yearly until the minor reaches age six. The Probate Court handles other matters such as allowing persons to deposit their will in a designated vault delayed registration of foreign births, opening decedent safe deposit boxes, poor person petitions, signing notary public applications, secret marriages, appointing members to the state boundary commission, and tax commission. The primary areas over which the Probate Court has jurisdiction are: Matters relating to the estate of a deceased person; Trust proceedings, Guardianships and conservatorships; Persons found to be mentally ill or developmentally disabled; Condemnation and drain cases; Juvenile delinquent cases; Dependent and Neglect cases; Adoptions; Name changes; Secret Marriages; Emancipations; Filing of wills and Codicils for safekeeping; Acknowledgements of Paternity; Recall petitions and hearings for such matters as school board members, township officials; Clinton County Youth Home, Green Haven and the Child Care Fund.
