In the present scenario capital punishment give rise to great abhorrence among the people. The intendment of capital punishment is to chastise the evildoer, to create fear among the people so that no one shall recapitulate the mortal sin (offence). A study on the mentality culprits had many time unfurled ratiocinate that, criminal minded people have more fear of being annihilate in manner of corporal punishment and due to fear of capital punishment they stay away from criminal acts. According to law, crime has two basic elements mens rea' i.e.mental element and the other one is actus rea' i.e. act done. It is to be proved that the mental intention is involved in crime then only it can be said that the crime has been committed, and in case where the gravity of offence is very high, where the crime is committed in a brutal manner where the evildoer becomes coldblooded then only this capital punishment is awarded, because in such case the felon becomes eminent danger to the people if the felon is out side the jail, or otherwise becomes eminent danger to the other jailbirds, if capital punishment is not awarded to the culprit. The necessity of capital punishment lies in those circumstances where the criminal is coldblooded criminal (one how commits crime without any hesitation). Imagine when hardcore criminals move scot free there will be total carnage of innocent public. To prevent this sometimes it is necessary to award capital punishment as the only remedy. Capital punishment is awarded only in rarest of the rare cases. In every criminal case a chance to become civilize is given to the felon and if there is no remorse to the evil act done by the felon then only the capital punishment is awarded. The capital punishment is only awarded when incumbent situation exists. The very purpose of capital punishment would be defeated and will render itself as inoperative, invalid and ineffective, in case the hardcore criminals are allowed to move scot free.

The motive behind each capital punishment is:

1. Firstly, to punish the evildoer, who has done mortal sin intentionally and have no remorse to the evil act done by the wrongdoer.

2. Secondly, to set an example to all that if anyone commits offence of this very nature the result would be this.

3. Thirdly, to safeguard the life of people from the cold-blooded criminals.

4. Fourthly, to maintain the integrity of law and order.

5. Fifthly, to do justice to the victim.

Epitomize to this capital punishment should not be extirpated in India. The discernment to this is because due to abhorrence of capital punishment the crime rate is low but when there will be no such fear among people there will be state of affliction and there will be total chaos in the society.
