Woman Pursues Case Against Paramedics For Acts Leading To Stillbirth
Many times, paramedics are first responders to medical emergencies
. Paramedics are licensed health care providers who owe a duty to meet the standard of care to those they respond to and treat. Their ability to recognize symptoms, to make fast and accurate choices as to whether to contact a physician for help, whether to administer drugs or do a procedure right then and there, and whether to move the person right away to a hospital, can actually make all the difference. In what follows we examine a lawsuit in which paramedics responded to a woman who had suffered a placental abruption at almost full term of her pregnancy. The paramedics did not appreciate the symptoms exhibited by the pregnant woman, including being in shock from blood loss, and failed to take her immediately to a hospital. In the time that lapsed the baby's oxygen supply was restricted because of the placental abruption.
The total delay in the time it took the paramedics before they made the call to transport the woman to the hospital where the newborn was delivered was at least eighteen minutes. During the 18 minute delay before the pregnant woman was transported to the hospital the baby was deprived of an appropriate supply of oxygen due to the loss of blood from the placental abruption.. The newborn died just day after being delivered. The mother's blood loss was so severe that she required an additional surgery to control the bleeding and later temporarily lost kidney function. The law firm that handled the case named the paramedics in the lawsuit.
States have different laws in situations involving the death of a baby. In the State where this situation arose, for example, in order to be able to recover for the emotional damage suffered by the woman due to the death of her bathrobe for kids the law firm that handled the case had to show that the mother (1) experienced a physical injury that resulted from the same negligence that caused the demise of the baby and (2) that such physical injury to the mother would not have normally occurred in a normal childbirth. After 6 months from the loss of her baby, the mother began enduring serious depression which, despite a regimen of therapy and prescribed drugs, continued through the time of the law firm's report and will require the lifelong use of medication. The mother met every condition.|All three requisites were present in this case.|With the injuries the mother herself endured from the delay by the paramedics, she was able to pursue a lawsuit.
The mother was successful. The law firm that represented her reported that after taking the case to trial the jury returned a verdict in her favor and awarded her $4,500,000. Paramedics are health care providers. Paramedics are trained and they are licensed. They are expected to be able to recognize symptoms of serious health issues and to take proper and timely action. Should they not and their actions fall short of the applicable standard of care, they can be liable.
