El pasado mes de julio la Sala de lo Contencioso del Tribunal Supremo dictó 3 sentencias como consecuencia de 3 recursos presentados por Experian, ANEF y la Federación de Comercio electrónico y marketing directo que pedían la nulidad de ciertos artículos del Reglamento de Desarrollo de la LOPD. En concreto, estas sentencias vienen a anular los siguientes aspectos: Última frase del Artículo 38.1 a). Este artículo regula los requisitos para poder incluir datos de carácter personal en ficheros de información sobre solvencia patrimonial y crédito. A partir de ahora, solo en el caso de existir reclamación judicial o arbitral se parará el proceso de inclusión.
