The recent case, Seung v. Regent Seven Seas Cruises, Inc. involved a California resident who was injured on a cruise which departed from Tahiti and only covered ports in French Polynesia. Seung was financially unable to bring her claim in Paris, and even more ironic, was physically unable to travel to Paris due to the injuries she suffered in the cruise ship accident. Despite her limitations, the Court upheld Regent's "international forum selection clause" stating Seung failed to make the "strong showing" that enforcement of the forum selection clause would be unfair or unreasonable under the circumstances.
