Response to the electronic cigarette issue, the FDA took the entry nlockade measures. But it's soon blamed. FDA (Food and Drug Administration) was trying to manage the tobacco industry in the late 1990s. It also gained the support of the president Clinton at that time. But finally in the joint action of tobacco enterprises, the USA Supreme court held that the FDA has no right to set foot in the tobacco industry.
Until in June, 2009, after Obama signed the related law, FDA has officially become the management of the tobacco industry. But in face of the complicated tobacco industry regulations, its ability to work is limited.
On June 22, 2009, the predident of USA Obama signed the "Family Smoking Prevention and Tobacco Control Act". The law empowered the FDA in the tobacco industry unprecedentely.
Professor Michelle Seeger from Boston University didn't attack the law directly. He thouth this is a vanity project of politicians. It will produce little effect finally. He furtherly pointed out that the law is the worst public law passed by U.S. Congress.
Yet the New England Journal of Medicine pointed out that the public expected a lot about the control of tobacco. It's expected that the law will have a positive effect on the public health.
Facing the different ideas, how would the FDA take the responsibility? What regulations will they work out?
Two characters mainly engaged in the tobacco regulations: the new director Margaret Hamburg and vice director Joshua M. Sharfstein. They pointed out on the magzine that the main task of the FDA is the health protection. They have been the supporter of the anti-smoking campaign for a long time. Hamburg said in an interview, "now we get the chance to play a role in the public health issue."
There is another official who plays an important role. He is Lawrence Deyton, the chief of the tobacco products center of FDA. Deyton is not the supporter of the anti-smoking campaign. He held a post in the Veterans Admistration before he came to the Food and Drug Administration. He is in charge of the pubic health and environmental hazard.
Comparatively, Deyton is an advocate of neutrality. He is a strict scientist who published more than 100 reputable papers. He belives the science determines the policy and the science will not be limited by policy. In other words, in the rulemaking of the tobacco management, Deyton holds different ideas from the two mentioned officials. He looks through the problem more ratinally.
All in all, the anti smoking ban forces is as strong as the supporting forces. The former president Bush ever declared to overthrow the related tobacco control law. But Obama supports the tobacco control standing on the opposite situation.
The gaming of political benefits has a direct influence on the tobacco industry. But the political rule is superior to the tobacco rule. Whether the FDA where coaches came and went can lead the tobacco industry rule under the circumstances. Maybe it remains to be seen.
