E-discovery: Your Computer Exposed

A new term used in courts today is called e-discovery

. This refers to the type of evidence you find in electronic devices. The types of evidence include cell phone conversations, email, hard drives, text messages, web history, blog postings, and others. This can be even stronger than testimonial from eye-witnesses and others.

The main purpose of e-discovery is to search for evidence or any other kinds of information on electronic devices. Occasionally, this can be used to look for evidence of crimes on the computers of suspects. Sometimes a copy of the hard drive on the computer needs to be made to keep an original.

When technology changes as quickly as it does today, those that wish to read and sort through the information inside the devices has to change quickly, as well. But no matter how hard they do to try and keep ahead of the technological curve; the government agents will never be able to do it. Technology moves too fast.

All the things stored on electronic devices is easy to search through and find. Delete doesn't really mean it's gone because that's now how computers work. They can continue to store information even after it is deleted, especially if it is on a network like the internet or an email account. These are even stored somewhere else.

All the branches of the criminal justice system can benefit from e-discovery, as well. As long as they have some way to communicate with those that perform e-discovery, no type of case is off-limits when it comes to getting information off of someone's devices. Any cell phone conversation or text message could contain lots of evidence.

The field of study called electronic study will constantly grow. It has to because technology is always changing, as well. As new technologies come out and offer ways for people to talk to each other in different ways, e-discovery has to learn how they work in order to infiltrate and dissect them. They have to stay ahead.

No one is safe from the reach of e-discovery. The best way to keep yourself protected is to use a firewall and any anti-virus software you can find. This will prevent people from hacking into your computer to use it for criminal activity. The other side is to make sure you don't commit the crime in the first place.

Now that you know a little more about e-discovery, you should ask yourself a few questions. A few of these include whether or not you think e-discovery is constitutional and if it violates your right to privacy.
