One person may only be able to handle a .05 blood-alcohol level before they start driving dangerously, and currently, there's no alcohol-related law which can punish those offenders. Austin Police Chief Art Acevedo supports the implementation of a DWAI law due to the extremely high number of alcohol-related car accidents occurring constantly across the state of Texas. The Austin American Statesman reports that a penalty has yet to be proposed for DWAI.

A DWI, on the other hand, is applicable for everyone else.
