How Law Affects Schooling Systems
There are quite a number of laws and regulations that govern schooling systems
, especially public schools, in today's society. Over the past fifty years, they have become more and more specific as they have adjusted to changes within America's economy and demographic.
Today, it is hard to believe that places of education were once segregated according to the students' backgrounds and color of skin. Up until the 1950's, Caucasian students and students of African American descent were forced to learn at different establishments.
These laws were especially strict in the South of America, where discrimination and prejudice from slavery were still prevalent in society. However, the judicial case of Brown vs. the Board of Education in Kansas made it unconstitutional for people of different ethnicities to have to go to different schools.
This is one manner in which law has affected the public schooling system. Without this litigation, equality may never have been reached and places of education may even be very different today.
Cases have also decided the process of integrating other ethnicities into schooling systems within the past fifty years, including Native Americans and Hispanics. America has become a country of many different colors and cultures, and without these cases and the prosecution of systems refusing to let non-Caucasian learners into their classes, the makeup of the United States may be unrecognizable today.
As time passes and as society changes, the need for law and attorneys representing schools becomes greater and greater. There are a number of lawyers that do not only represent individuals and people in need of help with divorces and personal injury cases; they also consult and act on behalf of government systems, businesses, and public schools.
The fact that diverse youngsters of all different backgrounds and races are able to learn together is a great achievement; however, it leaves a great deal of room for discrimination and possible litigation.
Many elementary and secondary establishments must have lawyers that represent them, in case of an issue with teachers and students, parents, or with the state or city government. Boards are created and put in effect to decide what is best for those that are part of that district and which laws and regulations are appropriate and not appropriate to govern.
Attorneys are available for the protection of pupils. There have been a number of cases where some wrongdoing occurred on the behalf of a teacher, and the individual affected was protected and represented by a lawyer representing that specific district.
However, they are also set in place to protect the district or system, itself. Very often, parents and pupils become angry at schools or specific teachers and try to place unjust blame on them for an issue or problem.
When this happens, it can be a very trying situation from the board of directors, as well as the place affected. Law is used to protect these establishments from being shut down or facing unjust fines.
The border between what is acceptable and not acceptable within the class room has been declared and enacted as law by state governments. These regulations are kept by all of the teachers and administrators in a district.
When they are not followed properly, those individuals are at fault and may be subject to litigation. The creating of codes may seem like it puts unnecessary restrictions on the professionals involved in running the schools and districts.
However, they are really there to create order and make it easier to run the establishments. There are a number of codes and laws.
There are some that govern teacher/pupil relationships, which obviously protects minors from becoming involved in illegal situations. There are also some that set a specific curriculum that must be taught, which makes it easier for the instructors to create a yearly lesson plan and makes it easier for learners to have a steady and stable basis of knowledge year after year.
Law affects these types of systems in a huge way. Without the codes and regulations put in place, learning academies would not have a stable curriculum or a sense of control.
As the people and establishments change, new laws may be brought into effect. The more order is kept within school systems, the easier it will be for youngsters to learn and advance in gaining knowledge within their lives.
