More Health Spas Under Attack From Compensation Seekers
Following a recent onslaught of liability claims made against health spas in lots of areas
, many are now having to review the way they deal with customers. The number of claims last year increased by 36% according the National Spa Association, the majority of which were related to massage and physical therapy treatments. The situation has led to an increased focus on the detail of spa treatment screening forms for clientele, and more legal protective procedures to be put in place.
A case last year of a woman suing a local spa after she claimed she was injured by a bad massage, is likely to have fuelled the fire a little and increased related claims activity. Even though she had previously sought medical treatment for issues related to her back, she verbally confirmed with the therapist that she no longer had any problems. Even so, she still decided to sue the spa when the massage left her with supposed mobility problems and she was awarded a five figure pay out.
This legal "victory" has seemed to have encouraged more people to see if they can get a slice of the pie. Although most of the cases have also been related to massage treatments, there are also lots of incidents such as skin burns, hair loss and even weight gain that people have tried to claim for. There has been a lot of speculation that for the most part the claims are fraudulent and filed by serial compensation seekers. A number of insurance companies have announced that they will take strong legal action against false claims, but this is still a worrying time for any health spa or self-employed therapist for that matter.
Spas are being urged both by insurance companies and spa governing bodies to not only cover themselves with thorough screening forms and disclaimers, but also make sure their standards are the highest possible. They are advised to source any spa products from reputable companies, service and check over their equipment as often as possible, and maintain regular high quality treatment training for their therapists.
One spa in New York has even taken it upon themselves to employ a full-time doctor to assess every client that wishes to have physical treatments at the spa. This might sound extreme but companies are really that concerned that people will claim they were given a treatment when they should not have been allowed.
