Criminal offenses in Texas are classified as either felonies or misdemeanors based on their degree of seriousness
. Misdemeanors, the least serious of crimes, are further differentiated by degree (or class), a list of which follows. Many crimes that are categorized as misdemeanors may be enhanced to a higher-level offense if the defendant has previous convictions on his record. Lets us consider Driving While Intoxicated as an example. DWI is categorized as a Class B Misdemeanor for a first-time offense. If a person has one prior DWI conviction, then the punishment is increased to a Class A Misdemeanor. If the person has two prior convictions for DWI, then the punishment is increased to a Third Degree Felony.
