Using A Local Law Library
I am not an attorney, I am the nation's only judgment referral expert
. This article is my opinion, and is not legal advice, based on my experience in California. If you ever want legal advice or a strategy to use, please contact a lawyer.
Most people aren't attorneys and do not work at legal firms. Many judgments are not large enough to be cost effective to retain an attorney to recover them. Enforcing judgments might need fairly complex legal paperwork and procedures, and when judgment owners need to research their own law matter, law libraries are very helpful.
Many counties have law libraries, which are often either part of, next to, or near to a courthouse. Most are sponsored in some way by a local bar association. Law libraries are usually never crowded, especially in the current economy. While a law library is designed for attorneys and mostly attorneys use them, nearly all allow cleanly dressed, polite, and quiet mortals to get access to everything.
Very often there are only one or two employees on duty at a library. Although they will answer questions, they aren't able to train you. A law library is intended for people to show up, do some research, then exit after you're are through. Nearly always, their employees are very polite. When they have time, they are usually very helpful.
A law library have a large array of legal resources, which allows you to access information and answers for many questions about any legal matter, for example judgment recovery. Usually they have judgment enforcement books for every state. Nearly all law libraries offer computers where one may (at least for a limited time) access Lexis Nexis, Westlaw, and other sources. This allows you to find public records which might show your debtor's assets. Expect to pay a nominal charge to print on their printer.
Law libraries have information on a vast number of areas including bond claims and what is requires to recover from them, Rutter's BK Practice guide, sample motions, laws, and some case law which discusses them. For California, the Pleading And Practice books are very useful. Most offer countless books that would cost an amazing amount to buy.
There are some judgment enforcers who discreetly and primarily operate their judgment recovery business mostly at law libraries. When required for a meeting, some recovery specialists rent rooms at the law library for a small fee. Sometimes they meet judgment owners and judgment debtors at the courthouse or the recorder's office, that are both most often very near to a law library.
If you use law libraries to conduct a business on a regular basis, you must be quiet and respectful, and perhaps bring bagels or donuts at least once a week. If there is a time limit on the time you may remain there each day, one could find another law library close to you.
Law libraries always have copiers you may use for a nominal fee. If one brings a laptop, some even offer a printing port so one may print out any documents and agreements. At (e.g.) 40 cents a page, it is probably less expensive than driving back and forth to your home or office. You may meet with people at the law library, and there is usually a nearby place to have documents notarized.
As many law libraries are very near the court, in locations where parking near the court is difficult to find or too expensive, some people park at the law library when they need to make a short visit to the court. That is is most often not permitted, yet it happens each business day. Law libraries are underutilized and really valuable for everyone with a law matter to research.
