Deciding Who Does What In A Partnership To Avoid Business Partnership Disputes
Business partnerships that work well are made from relationships between those who know their own area of expertise.
One partner, for instance, will be best suited to the creative side of the business, handling the overall image, marketing and advertising, but will not so easily handle the figures. Someone has to fill in the spreadsheets, liaise with the bank and take care of orders, payments and invoices. Two creative people, or two who are both financially-minded, will simply replicate each other's work.
If two or more partners are trying to do the same job, in their own ways, it can lead to a situation where one or other of them thinks that they know best, which in turn will lead to animosity, acrimony and business partnership disputes. Before entering into a partnership, all partners must feel they have their own role to play, be confident in their abilities in that role and be sure that their performance in that role will contribute equally to the success of the business.
It can never be stated too often that trust is the key to a successful partnership, and a breakdown of trust will inevitably lead to business partnership disputes. If one of the partners has agreed to taking on a more hands-on or more physical role in the business, they must trust that other partners, who may be working on their computer from home, are putting in just as much work. Each partner should stick to what they know best. Starting off on the right foot, with all concerned comfortable in their positions, will undoubtedly help to avoid business partnership disputes.
Occasionally, outside help is needed in a partners dispute. The best course of action, if partner disputes do occur and cannot be resolved by discussion between partners, is to meet with the company's solicitors, who would have helped to draw up your partnership agreement in the first place.
Your solicitors will be able to look at any business partnership disputes from a distance, and not become emotionally involved, as the partners in the business are bound to be. The professional insight and experience in resolving business partnership disputes of your solicitors will be invaluable to your business. A meeting with someone who can bring an insightful oversight to your business will put a partners dispute into perspective. Without their help, small problems could escalate and lead to a business partnership dissolution, which no-one involved could have foreseen, or would have wanted, when the business had its optimistic beginnings.
