The benefits and drawbacks of current school illegal drug testing

Today there are several benefits and downsides in the school drug test debate that's a hot topic of discussion in lots of schools as well as amongst parents, school faculty and kids.

A few suggest that the main purpose of on the spot college drug tests isn't in order to detect teenagers who are using illegal drugs, but to prevent them from ever trying drugs, legal or otherwise. Once kids are using drugs it is a lot more difficult for them to end the addiction that they have. Perhaps it's because of peer pressure, that is the largest cause of many kids using illicit drugs. Provided that just by testing the athletes or additional university students, we could make them just say no to illicit drugs, it would be way easier for more kids to just say no.

However, one of the main fundamental features of our present legal system is that we are assumed to be innocent unless and until the government proves differently. Random school drug testing of student athletes flips that premise upside down, telling kids that we conclude that they are already on illegal drugs unless they prove the opposite with a pee sample.

The constitutional prohibition against unreasonable searches, that furthermore proves the principle that just hanging out in a particular pack is not an adequate enough reason for a search, even if lots of people in that group have been suspected of drug use. For example, even if it were true that most people who go to a certain club were drug users, the law enforcement would not be allowed to stop all those people who frequent that establishment.

Young people who participate in in athletics, music programs, in addition to after school activities can increasingly be subject to randomized drug testing, because of a program supported by the Bush administration. There are some parents, teachers in addition to university administrators who are calling it a heavy handed, ineffective way to dissuade illicit drug use that simply undermines trust as well as invades the students personal privacy.

In lots of workplaces and in the armed forces, there's been drug tests going on, on the other hand courts have already ruled that public schools can't perfrom random drug testing on an entire student body.

But, the Supreme Court had ruled in 1996 that colleges may randomly test student sports teams who aren't suspected of drug use. In 2003 it was ruled that all kids that participate in voluntary activities, like sports, band, or the chess club, may be made to take on the spot testing as well. Since then, the current administration have spent $11 million in order to help colleges foot the bill for drug testing programs. Additionally, the White House would like to spend $18 million on drug testing grants in the next year.

There are around 500 school districts in the U.S. that use drug tests, according to officials from the White House Office of drug control policy. White House administrators compare drug testing to the programs that test for influenza or other health concerns, and said young people who test ok don't face criminal charges.

Others assume that if the parents would simply take the time to speak with their kids about drug abuse and if they believe their teen is using drugs, the parents must take actions beginning at home. There are several teen drug test kits on the market these days. As long as parents upheld their roles as parents, then the teachers, faculty and the government wouldn't have to step in and force the subject of college drug tests.
