Self-defense is the act of defending yourself. It has been put in place to protect those who may be in a situation in which they are harmed by protecting themselves. Self-defense allows a person to physically defend themselves when they have to and not to be held responsible for any consequences in the court of law. When a self-defense case is taken to the court there are a few factors that they consider, including the person who you defended yourself from, the level of the defense and why there was an altercation in the first place. These main factors are used to determine whether a person should be put in jail or not.

There are two concepts in the legal arena concerning the thought of self-defense that make it easier for people to have peace of mind about defending themselves without the worry of going to jail. There are some states which permit you to carry a weapon on your body and other states which allow you to not only shoot an attacker but to kill them. Its important to find out the laws in your state so you are well informed of what you are able to do to defend yourself and not to be sent to jail.

A concept exists that allows home owners to defend themselves and their family members. This concept is called the Castle Doctrine and provides protection on the property you live on. This particular bill gives the homeowner the ability to use deadly defense against a burglar or intruder from a violent attack or actions that might lead to one. When it comes to killing a person who enters your home with the intent of violence or an intrusion which might lead to a violent attack, you do not need to worry about being prosecuted.

Another bill which is being passed into the legislature is the Stand your Ground bill. Florida is the first state to adopt this in 2005 and since then its being considered by 21 other states. This bill allows a person in public to defend themselves with force when met with a violent attack and not be prosecuted as the victim. If the person is legitimately defending themselves then they will not go to jail.

States and legislatures are now realizing that criminals are slowing down when it comes to committing a crime because they know there is a risk of them being shot or killed. If criminals think they are protected by a law which wont let the person they are attacking kill them, then this is more of a chance they will continue to commit crimes of all levels.

Nevertheless there have been people who have gone to jail due to acting in self-defense. Fortunately the laws are changing as they recognize the associated factors with self-defense and are realizing its okay to protect yourself, your family and your property from harm with whatever force necessary. Its important to find out about the laws that have been put in place in the state that you reside in.
