You are at your place of employment and sustain an injury that is not your fault

. Maybe there is a pallet filled with bags of concrete and they are stacked up precariously. You are told to move the bags to a nearby shelf for storage. The injury must have happened in the course of performing the workers normal duties.

Any insurance benefits are paid instead of the employee suing his or her employer (signing away the right to sue). This is known as a 'compensation bargain'.

General types of damages such as punitive damages and pain and suffering, are not available with workman's compensation plans.

A doctor, usually assigned by the employer, will diagnose the employee regarding their injuries, and in many instances will give them a drug test, as per the law.

Employee compensation laws or accident at work compensation is generally a feature of highly developed industrialised societies who, in many instances, have worked hard for this benefit through trade unions and various employee groups. It has been seen that having these policies in force, tends to improve safe working conditions, along with providing a safety net for employees in case of accidental injuries on the job.

Before workman's comp came into being, employees who received injuries while on the job, could only be compensated for any medical bills or loss of work through civil or tort laws, and law suits never endear us to our employers. These suits tended to be ruled in favour of the employers as well. Employees were expected to be on the job, in spite of the severity of their injuries, if there was any form of work they could do. Evidently it is cheaper for many employers to simply train a new employee, rather than compensate one who was injured (through no fault of their own), while doing their job.
