There are different sets of requirements for New York CLE carry over credits for experienced attorneys than there are for newly admitted attorneys

. There have been new updates that have come about regarding carry over credits in the state, so here are a couple of the most frequently asked questions that pertain to New York CLE. The first two questions apply to existing attorneys, and the remaining ones are meant for newly admitted attorneys. It is important to realize that not only are requirements different from one state to another, but they also differ for experienced attorneys and attorneys who are newly admitted. Reporting cycles and deadlines differ quite a bit, and there are many new questions that arise regarding the requirements for professionals along with many changes that happen.

1: If I earn more credits than my prorated requirement in the reporting cycle, can I carry over the extra credits into the next reporting cycle? The answer here is yes. Attorneys can carry over up to six extra credit hours in any of the categories of credit into the reporting cycle that comes next.

2: If I complete the extra credit hours during my time extension, can I apply those excess credit hours to the current reporting cycle? Again the answer is yes. Any credits that are extra are earned can be applied to the current cycle, so dont worry! This also applies if you have been granted an extension of time to complete any outstanding credits.

3: If I apply credits to my first year New York CLE requirement and then I earn more during my first year, can I carry over those extra hours to the second year requirement? Yes. As long as attorneys have satisfied their first year requirements, which include 6 in skills, 3 in ethics and professionalism and 7 in law practice management and they earn that excess credit during the first year, they can carry over up to 8 extra credits to the second year requirement except for Ethics and Professionalism credits.


4: My birthday falls before my admission date, so if I complete my requirement before the second anniversary of my admission date and then earn more credits, can I carry over the excess hours into my experienced attorney reporting cycle? Yes! As long as attorneys have satisfied the newly admitted attorney credit requirements completely, they can carry over up to six hours into the experienced reporting cycle. They can also apply up to twelve of the 16 credits that are earned during the second year to the experienced attorney requirement.
